The Dutch Employment Law


The Dutch Employment and Labor Law is complex and elaborate. An employment contract under Dutch law can be concluded orally or in writing. However, the employer needs to inform the employee about certain aspects.

Amongst the most important, there are:

  • - position and job description;
  • - hiring date;
  • - place where the work will be carried out;
  • - if the contract has a fixed period of time;
  • - remuneration;
  • - working hours;
  • - pension rights (if applicable).


An employment contract can be negotiated for a fixed amount of time or for an unspecified period of time. Restrictive clauses often found in employment agreements are the confidentiality clause and the non-competition clause.

Foreign employees in the Netherlands

Not only does Holland have its own pool of talented workforce, but it also attracts talented foreigners. In order to work in the Netherlands, a foreign employee must have a residence permit. For skilled individuals, the government has enabled the Highly Skilled Migrant Visa Program which eases the process of Dutch companies hiring foreign citizens.

Afterwards, the employer is obliged to obtain an employment permit. Employees from the European Economic Area and Switzerland are exempt from this rule.
